1. General
These Terms & Conditions apply to purchases made through the Ndrackgmbh online store.
By placing an order, the customer agrees to these Terms & Conditions. The applicable product information, price, delivery information and other conditions displayed on the website at the time of purchase form part of the order.
Nothing in these Terms & Conditions limits any mandatory rights granted to consumers under applicable German or European law.
2. Products and Orders
Product descriptions, specifications, images and other information are provided to describe the products offered through our website.
An order is processed after the payment associated with the order has been confirmed. We generally process orders within 1–3 working days.
An order confirmation containing the relevant order information will be sent to the email address provided during checkout.
3. Prices and Payment
Prices displayed on the website are stated in the applicable currency and include any legally applicable taxes where required.
The total amount payable, including any applicable delivery charges, is shown before the order is completed.
Payment must be completed using the payment methods made available during checkout.
4. Delivery
We serve customers across Europe and arrange delivery using carriers such as DHL, FedEx and UPS Priority services, depending on the destination and the applicable order arrangements.
The standard delivery period is approximately 5–10 working days after dispatch. Actual delivery may vary depending on the destination, carrier operations and local delivery circumstances.
Tracking information is provided by email to the address supplied with the order at relevant stages, including when the order is dispatched, reaches a logistics point and enters local delivery.
If an order exceeds the standard delivery period, we may initiate an enquiry with the relevant carrier. Following the outcome of the enquiry and the circumstances of the individual order, we may arrange a refund or a replacement shipment where appropriate.
5. Delivery Risk and Ownership
For consumer purchases, the risk of accidental loss or damage remains with the seller until the goods have been physically received by the consumer or by a third party designated by the consumer who is not the carrier.
The transfer of the goods to a carrier does not, by itself, transfer the consumer’s delivery risk.
Ownership of the goods passes in accordance with applicable law and the terms of the individual purchase.
6. Right of Withdrawal
Consumers have a statutory 14-day right of withdrawal for eligible distance contracts.
The withdrawal period generally begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, receives the goods. The consumer is not required to provide a reason for exercising the statutory right of withdrawal.
To exercise the right of withdrawal, the consumer may send a clear statement by email before the withdrawal period expires.
After a valid withdrawal, the goods should be returned in accordance with the applicable statutory requirements. Unless otherwise required by law or agreed by us, the direct cost of returning the goods may be borne by the consumer.
Any refund following withdrawal will be handled in accordance with applicable law. Where permitted by law, reimbursement may be withheld until the returned goods have been received or the consumer has provided appropriate evidence that the goods have been sent back.
7. Damaged, Defective or Non-Conforming Goods
If goods arrive damaged, defective or do not conform to the purchase contract, the customer should contact us by email and provide the relevant order information together with photographs or other appropriate evidence.
Where appropriate, we may arrange a refund or replacement based on the circumstances of the case.
For goods that are visibly damaged on arrival, photographs may allow the matter to be assessed without requiring the customer to return the affected goods. Where a return is legally required or reasonably necessary to assess a claim, appropriate return arrangements will be provided.
Nothing in this section restricts statutory rights relating to defective or non-conforming goods.
8. Statutory Consumer Rights
Consumers retain all mandatory rights provided under applicable German and European consumer law.
Where goods do not conform to the contract, statutory remedies may include repair, replacement, price reduction or termination of the contract, subject to the conditions and order of remedies established by applicable law.
These statutory rights apply independently of any additional return or customer service arrangements described on this website.
9. Order Information
Customers are responsible for providing accurate information required to process an order, including the delivery address and email address.
Where incorrect information provided by the customer affects delivery or order processing, the customer should contact us promptly so that the available options can be reviewed.
10. Customer Communications
Order-related notices, including order confirmations and tracking information, may be sent to the email address provided during checkout.
Customers should ensure that the email address supplied with an order remains accessible and that relevant order communications can be received.
11. Applicable Law
These Terms & Conditions are governed by applicable German law, subject to the mandatory consumer protection provisions that apply to consumers in their country of habitual residence where such provisions are applicable.
Nothing in these Terms & Conditions excludes or restricts mandatory statutory rights available to consumers under applicable law.
